As our population ages, the need for nursing home, assisted living, skilled nursing and other long-term care services is increasing rapidly. However, litigation against these entities continues to threaten the ability of long-term care providers to survive and provide these critical services.

Our attorneys are at the forefront of this litigation and understand that quality long-term care facilities are essential to the ongoing care of our elderly population today and in the future. We have been intimately involved in the aggressive defense of claims against these facilities in order to protect their interests and to protect the long-term care industry, in general.

Our attorneys have successfully defended long-term care facilities, their owners and employers, and management companies associated with these facilities in a variety of actions alleging negligence, nursing home malpractice, abuse and neglect, residents' rights violations and wrongful death. We act as regional and local counsel for a number of long-term care facilities in every stage of litigation including overseeing investigations and handling all pre- and post-trial proceedings and appeals. In addition, our attorneys review and develop employment and documentation policies and procedures and provide preemptive risk management strategies.

Representative Cases

Successfully defended and obtained a defense verdict for a physician at a long-term care facility in which his patient developed pressure wounds.

Prevailed on behalf of a nursing home management company in an action alleging negligent care and treatment resulting in patient developing pressure wounds and bilateral lower extremity amputations.

Successfully defended a nursing home against imposition of punitive damages for alleged negligence and wrongful death of a resident.

Received a defense verdict for our nursing home management company client in an abuse and neglect action which found the nursing home liable.

In a number of cases, successfully asserted arbitration agreements signed by residents and their long term care facilities, resulting in the movement of the action from local court jurisdictions and jury trials to arbitration settings.
